Any one who knows me knows I've been around the block a few decades.
I could never understand why all the crooks and thieves live in FL. Well I know now. It is because there laws for proving a person committed a "white collar" crime like stealing my work, (and my name, reputation) etc.... is not something Law Enforcement will touch in their own back yard!
I know. A good man contacted me this week about http://www.ExamSaver.com
He already had purchased work I created for http://www.totalrecallpress.com and http://www.studyexam4less.com via ExamSaver.
The Clearwater, Fl based ExamSavers owned by Jason Bortz, is Out Right Lying via telemarketers that they have brand new material I created just for them! I had never heard of them before! Nor have I contracted or endorsed any work for them.
Well a little digging I discovered two things:
1) Jason and ExamSaver have judgments entered in court for failing to pay as agreed and collection agencies are after this outfit.
2) I spoke with no less than 3 government agencies in FL who bottom line said, we cannot help you. It is a civil matter to file in WA state. I guess FL thinks, as long as the money is coming to FL we don't care if its legal money earned or not. At least that it seems how the law works in Florida.
As I have said in this blog before. Bitching won't fix it. Action will.
I am asking you to boycott firms that are Florida based. Not just the criminals like Jason and ExamSaver who stealing from me my work and also affect my reputation with false and fraudulent assertions.
I want you to deny a dollar to the GOOD firms like SunBeltTools.com too. Stu from SunBelt has the power and the moxy to make FL lawmakers tighten up the scam haven they are running down there.
Sorry Stu. You’re a good man with a good operation. And you got the clout to fix your home state. That is the cross you have to bear. Leave FL or fix it. In the meantime, while I thank you for saving Kerio firewall and keeping it free to home users, I'm going to tell the world to take your free gifts and not give you a dime until you make FL fix itself or move. May I suggest Huntsville, AL ? Nice people, lots of tech folks due to the Goddard Space Center, low cost of living. Trade up buddy!

I'm gob-smacked that you're asking people to boycott all organisations within Florida - including an organisation you belive is a good operation -because you disagree with the law enforcement policy of the state as a whole. Well shucks, there's a number of policies that I think the USA as a whole has is misplaced on, so should I encourage the rest of the world to to boycott the the US of A and in particular, mention your blog as being 'good but boycott it anyway until it's willing to move to Spain'?
First, the argument is just plain crazy. I was once robbed within the district of London and the police told me there was nothing they could do about it (not having unlimited resources and all); should I therefore ask people to boycott entering the vicinity of London? I'm struggle to follow your reasoning, except to suggest that it's a knee-jerk reaction.
Second you and the purchaser have only been hurt commercially (sure that's a bad thing, but it doesn't rate up there with a burglary say), and it sounds like you've not actually suffered any commecial damage - you're just offended at their cheek? So yeah take action, legal action - that's why you're allowed to take private actions! This isn't a job for law enforcement officials, who one would indeed hope have bigger fish to fry, this is a job for you!
I can understand and sympathise with your urge to hurt the immmoral here. But to try hurt all organisations merely because they're based within Florida? Ruddy hell!
And if I was Sunbelttools.com I'd consider taking legal action against you. You've asked people to boycott them when, by your own admission, they've done nothing wrong. Aren't you the pot calling the kettle black here? You're hurting organisations without good cause to do so.
examsaver rocks! I passed my MCSE in a year and I owe it all to that software...I dont believe a word you are saying..TCAT! sounds like you got resentments?!
It seems to me that mixing a criminal outfit like ExamSaver (if they are indeed criminal) with a good outfit like SunBelt is a bit abberated. That some of the companies in Florida are thieves would be a more true statement. That some are good is also true. Do you agree?
Oh, yeah. These guys seem dirty! Just reading the T&Cs makes it pretty obvious. I just wish I'd found an entry like mine before I even bothered to accept their verbal offer. I won't get burned for $$ but others might very easily. If you don't use a CC for the order, I'll bet you will pay dearly for certain. Read carefully the exerpt from their website after my add'l commentary...
So here's the story... This applies to the AMAZING "Lifetime Membership offer" (yeah, right)
Yes, it doesn't look like a bad deal overall for the 'young, eager, got to get cert'd in as much as I can, as fast as I can' types. Right off the bat, the verbal sell misrepresents the offer.
1) DO NOT OPEN THE PACKAGE
The T&C states that the DELIVERED package must be returned as is or you're liable for the ENTIRE commitment. Any breach implies they can cut you off without further compensation.
2) The nice fellow walks you through a 4 step intro. Nice that he never mentions the T&C page. I mean come on, with the obvious restrictions, this is a bait and switch.
3) This doesn't look like a training system as represented. From what I can tell from any other (minimal) postings, it is a cert prep, just like you can get from a dozen other players.
4) The phone solicitor makes no mention of the 2 titles/6 month restriction without taking a test. If you just want to enrich your knowledge base, and know you are cert capable, you are SOL. It is not allowed without restrictions.
I mean if you are going to charge thousands of $$ you ought to be able to get more than 4 courses worth of material each year. Afterall, that's 5 or more years before you get close to break even over books $$ from the store. The books are right off the vendor presses according to the order. That's about $50 bucks or less a pop from Amazon. What if you change your direction?
5) You call them and they say you'll get better response from an email. HA HA, I sent them an early email and got a response at 11am "We have received your request. We will be in contact soon. Regards, Support". No word after that, looks like a probable stall. Again, note the return terms..
Well, we'll see if they honor the return or if it is a dispute through my CC. Here's the T&C exerpt:
